Tenant Selection Criteria

 

These criteria are being provided in reference to the Property located at the following address:         

                                                             3815 Red River St., Unit B, Austin, Texas 78751 (“Property”)

 

Pursuant to Property Code Section 92.3515, these Tenant Selection Criteria are being provided to you on behalf of the Landlord (Property owner) by the broker//propertymanager/company/agent shown below.  The Owner/Landlord has established the following tenant selection criteria that apply to all prospective tenants and/or applicants. The following constitute grounds upon which Landlord would be or will be  basing a decision to lease the Property to you.  Based on the information you provide, Landlord may deny your application or may take other adverse actions against you based upon application these tenant selection criteria. If your application is denied or another adverse action is taken based upon information obtained from your credit report or credit score, you will be notified. 

 

  1. Criminal History: Landlord will perform a criminal history check on you to verify the information provided by you on the Lease Application.  Landlord’s decision to lease the Property to you may be influenced by the information contained in the report. 

 

  1. Previous Rental History from Unbiased Sources Landlord will verify your previous rental history using the information provided by you. Previous history must be from unbiased sources for prior 4 years. Your failure to provide the requested information, provision of inaccurate information, or information learned upon contacting previous landlords may influence Landlord’s decision to lease the Property to you. Prior evictions will be a negative factor.

 

  1. Current Income: Landlord may ask you to verify your income as stated on your Lease Application.  Depending upon the rental amount being asked for the Property, the sufficiency of your income along with the ability to verify the stated income, may influence Landlord’s decision to lease the Property to you. Landlord may ask to see 2 years of your tax returns in order to verify, 2 years of pay stubs, and 3 months of bank statements

 

  1. Debt to income ratio or rent to income ratio: Landlord may ask to determine the number of debts that you have in relation to your gross income (debts should not be more than 50% of monthly income) or what percentage of your monthly income would be needed to cover the monthly rental amount (rent should not consume more than 35% of monthly income).

 

  1. Credit History: In  order to verify your credit history, Landlord’s will obtain a Credit Reporting Agency (CRA) report, commonly referred to as a credit report, containing among other things, your credit score. The decision to lease the Property to you will be based upon information obtained from this report.  If your application is denied based upon information obtained from your credit report, you will be notified.  Prior to obtaining a credit report, Landlord may also ask you to provide your current credit score.  Landlord requires at least a  “good” credit rating (695 or above credit score) from prospective tenants or applicants.

 

  1. Self-employment or commission or part-time income: Landlord may ask you to verify whether your income is derived from a monthly salary from an employer or whether it is self employment income or commission based income or part time income. Also, the duration of time at your present employer is a consideration that may be used by Landlord.

 

  1. Failure to Provide Accurate Information in Application: Your failure to provide accurate or complete information in your application or your provision of information that is unverifiable will be considered by Landlord when making the decision to lease the Property to you.

 

  1. Other criteria – The Property is a duplex style home in a condominium regime, subject to the rules of the condominium association which apply to all occupants and prospective tenants and all leases- some of which are:. only small dogs under 20 libs are allowed, only one car in driveway is allowed, no smoking or  vaping allowed, noise & nuisance rules apply, and  no commercial business may be conducted.

 

Acknowledgment of Receipt of Landlord’s Tenant Selection Requirements:

 

Signing this acknowledgment below indicates that you have had the opportunity to review the landlord’s tenant selection criteria which is available on request.  The tenant selection criteria may include factors such as criminal history, credit history, current income, and rental history.  If you do not meet the selection criteria, or if you provide inaccurate or incomplete information, your application may be rejected and your application fee will not be refunded; and providing inaccurate or incomplete information may be  grounds to declare a breach of lease.
